Terms of Service

These Terms govern your access to and use of the WithdrawKit Shopify app and related services provided by Florian ALBORA.

1. Acceptance of Terms

By installing or using WithdrawKit, you agree to these Terms. If you do not agree, do not use the service. These Terms constitute a binding agreement between you ("Merchant") and Florian ALBORA ("WithdrawKit", "we").

2. Description of Service

WithdrawKit provides a Shopify app that enables EU-compliant consumer withdrawal functionality on your Shopify storefront, including withdrawal submission, automated notifications, and audit record keeping.

3. Subscription & Payment

3.1 Plans

We offer Free, Essential, and Professional plans as described on our pricing page. Paid plans are billed monthly or annually in advance through the Shopify billing system.

3.2 Free Trial

Paid plans include a 14-day free trial. No credit card is required during the trial. At trial end, you will be billed unless you downgrade or cancel.

3.3 Cancellation & Refunds

You may cancel at any time from your Shopify admin. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods unless required by applicable law.

4. Acceptable Use

You agree not to: reverse engineer the app, use the app for unlawful purposes, or attempt to circumvent any technical limitations. You are solely responsible for ensuring your use complies with applicable laws.

5. Intellectual Property

All intellectual property in the WithdrawKit app, including code, design, and documentation, remains the property of Florian ALBORA. These Terms grant you a limited, non-exclusive, non-transferable licence to use the app for your store.

6. Compliance Disclaimer

WithdrawKit is designed to assist with EU Directive 2023/2673 compliance. We make no warranty that use of the app guarantees full legal compliance, which also depends on how you configure and use it. You remain responsible for your legal obligations.

7. Limitation of Liability

To the maximum extent permitted by law, Florian ALBORA shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of France. Disputes shall be subject to the competent French courts.

9. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use after the effective date constitutes acceptance.
